Get Pulse Giveaway: Nuggets Slam Dunk Sweepstakes (“Sweepstakes”) begins on 2023-06-01 and ends on 2023-06-30 (the “Promotion Period”).
Loveland Pulse (“Sponsor”) is sponsoring the Sweepstakes. By participating in the Sweepstakes, you unconditionally accept and agree to comply with and abide by these rules. You agree that Sponsor, in its sole discretion, shall make the determination whether you have abided by the rules of the Sweepstakes. Sponsor is responsible for the collection, submission, and processing of entries and the overall administration of the Sweepstakes. Sponsor makes no representations as to its ability to collect and process entries. You may submit any questions, comments or problems related to the Sweepstakes during the Promotion Period to Sponsor at: Pulse@LovelandPulse.com.
ELIGIBILITY: The Sweepstakes is open to legal residents of the United States who are 18 years or older and who reside within Pulse’s current or planned service territory. (To determine whether you reside in the service territory, you may consult the following map: https://www.pulsefiber.org/map.)
Loveland Pulse, its employees, officers, representatives, agents, are ineligible to enter the Sweepstakes or win a prize. Household members and immediate family members of such individuals are also not eligible to enter or win. Household members means those people who share the same residence at least three months a year. Immediate family members means parents, step-parents, legal guardians, children, step-children, siblings, step-siblings, or spouses. This Sweepstakes is subject to all applicable federal, state and local laws and regulations and is void where prohibited or restricted by law.
HOW TO ENTER: Enter the Sweepstakes during the Promotion Period online by signing up for Pulse service, adding a service to an existing Pulse account, or participating as a “referrer” in Pulse’s “Refer A Neighbor” promotion. Any person who completes any of these actions will receive a link to the entry form, and gets one entry per signup, change of service, or new customer referral. Automated or robotic entries submitted by individuals or organizations will be disqualified. Internet entry must be made by the entrant.

Any attempt by an entrant to obtain more than the stated number of entries by using multiple/different email addresses, identities, registrations, logins or any other methods, including, but not limited to, commercial contest/sweepstakes subscription notification and/or entering services, will void the entrant’s entries and that entrant may be disqualified. Final eligibility for the award of any prize is subject to eligibility verification as set forth below. All entries must be submitted by the end of the Promotion Period in order to participate. Sponsor’s database clock will be the official timekeeper for this Sweepstakes.
WINNER SELECTION: The Winner of the Sweepstakes will be selected in a random drawing from among all eligible entries received throughout the Promotion Period. The random drawing will be conducted by Sponsor or its designated representatives, whose decisions are final. Odds of winning will vary depending on the number of eligible entries received.
WINNER NOTIFICATION: The winner will be notified by email at the email address provided in their entry on Wednesday, July 5, 2023. Winner must confirm acceptance by email by 5:00pm MDT on Monday, July 12, 2023. If winner does not confirm acceptance by then, another winner will be chosen. The winner can pick up the prize at Loveland Pulse, 2695 W. Eisenhower Blvd., Suite 200, Loveland, CO 80537. Sponsor is not responsible for any delay or failure to receive notification for any reason, including inactive email account(s), technical difficulties associated therewith, or the winner’s failure to adequately monitor any email account. Any winner notification not responded to or returned as undeliverable may result in prize forfeiture. The potential prize winner may be required to sign and return an affidavit of eligibility and release of liability, and a Publicity Release (collectively ‘the Prize Claim Documents’). No substitution or transfer of a prize is permitted except by Sponsor.
PRIVACY: Any personal information you supply will be subject to Sponsor’s privacy policy posted on its website, subject to applicable law including the Colorado Open Records Act, C.R.S. § 24-72-201 et seq.
LIMITATION OF LIABILITY: By entering, you agree to release and hold harmless Loveland Pulse, its employees, officers, representatives, agents, from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) your participation in the Sweepstakes and/or your acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Promotion; (v) electronic or human error in the administration of the Promotion or the processing of entries. No term or condition of these rules shall be construed or interpreted as a waiver, express or implied, of any of the notices, requirements, immunities, rights, benefits, protections, limitations of liability, and other provisions of the Colorado Governmental Immunity Act, C.R.S. § 24-10-101 et seq. and under any other applicable law.
DISPUTES: This Sweepstakes and these rules are governed by the laws of the State of Colorado (regardless of conflict of laws doctrine), and venue shall be in the County of Larimer, State of Colorado. As a condition of participating in this Sweepstakes, you agree that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Sweepstakes, shall be resolved individually, without resort to any form of class action. Further, in any such dispute, under no circumstances shall participant be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees.

MISCELLANEOUS: These rules contain the entire understanding of the parties relating to the subject matter hereof and may not be modified or amended except by written approval by the Sponsor. In the event a court of competent jurisdiction holds any provision of these rules invalid or unenforceable, such holding shall not invalidate or render unenforceable any other provision.
